It is standard practice, for Alfonso X of Castile,1 to reinvent the means of writing the law. He does not limit himself to compiling or revising existing legal statutes; rather, he elevates (...) the corpus of the law to the level of juridical science. Dominating the meaning of the word—its hermeneutics and its relation to truth, lies, rhetoric, history, and poetry—is also the key to dominating juridical discourse itself and its capacity for creating certainty. Or, at least, for controlling uncertainty. Uncertainty, that is to say, the ambiguity in the interpretation of the relationship between words and things, appears to be one of the targets of Alfonsine juridical science.It is in the institutions that one can best study this desire for control. In particular, the need for control becomes visible in the court and the places related to it (the palace, chamber, or bedroom), codified by the law in order to put justice into action, in the representation of power, in cultural exchange, in education, and in recreation. Here legislation acquires a special significance with respect to the word, to narration, and to rhetoric. This is a philological problem: How does one compose and administer a text capable of controlling its own interpretation? How does one transpose this same dynamic to the institutions? How does one transmit this notion from the institution to those who inhabit it and who are, after all, the subjects of the legal science?It is therefore fitting to examine legislation about legal discourse, which is, in itself, the theory of law—not, however, in its abstract aspects but rather in the concrete elements of the formation of a legal vocabulary, in the way in which words, whose semantic and hermeneutic problems are clear, give life to this legal vocabulary. How is legal discourse constructed? In what way is it transmitted? What are the consequences of its dissemination? In what way is the law in charge of words, in particular, those expressed in the institutions?Perhaps the problem is philological, in the sense supposed by Giambattista Vico. Vico, in his Principi per una scienza nuova [1: 10] proposed that the study of philosophy, as a science of truth could not exist independently without a philology, the origin of the conscience of certainty (coscienza del certo). Attaching myself, then, to this idea of certainty (although not, of course, from Vico’s perspective) throughout this study I shall call “the space of certainty” the theoretical and conceptual construction (which is of both a philological and textual character) stipulated by the legislator in an attempt to control the distinct concepts related to the legal word, its institutional statute and its legal, moral, and cultural hermeneutics. I shall thus attempt to understand the meaning of this space of certainty, in what way it has been constructed, and how it affects legal, political, social, and cultural mechanisms. [End Page 64]1Law and KingIn the first title of the first Partida, Alfonso outlines the virtues of the laws.2 In addition, this first law discusses the overall structure of the Siete partidas, as if, in fact, they were nothing more than a lengthy and virtuous discourse about the law. It makes sense as the Partidas are not only a legal code capable of being enforced but also an enormous manual on legal theory. The law(s) and legal doctrine, then, come together to form the first expression of legal science. Going further than compilations of Roman law such as the Liber augustalis,3 further than the scientific expressions of jurisprudence of specialists from Bologna, the Île-de-France, and Orleans utroque iure,4 the Partidas—and I should like to insist on this—can be considered a constitutional legal text. In this sense the Partidas attempts to regulate the actual material from which the laws are made: language. This chapter introduces and discusses the concepts that are in-depth articulated in the volume. International migration is presented here as a test bench where the normative limits of institutional order, its contradictions and internal tensions are examined. Migrations allows to call into question classical political categories and models. Pointing at walls and fences as tools that reproduce enormous inequalities within the globalized neo-liberal system, this chapter presents the conceptual tensions and contradictions between migration policies and global justice. We challenge the (...) conceptualization of justice as a relationship between citizens of the same country and the State and argue that, in our globalized world, nation-state cannot constitute the basic unit of the theories of justice. We argue that an integral approach that includes the complex and interconnected forms of structural inequalities and transcends the borders of national sovereign states is required. Avoiding the methodological nationalism and the exclusionary biases that inform current migration and border control policies, this chapter finally places attention on the most marginalized subjects of the migration chain: migrant women workers. We point out the importance of addressing transnational structural inequalities and bringing social reproduction to the center of global justice theories. (shrink)

We may succed in the fulfilment of our desires but still fail to properly own our practical life, perhaps because we acted as addicts, driven by desires that are alien to our will, or as “wantons,” satisfying the desires that we simply happen to have (Frankfurt, 1988 ). May we equally fail to own the outcomes of our epistemic life? If so, how may we attain epistemic ownership over it? This paper explores the structural parallellism between practical and epistemic rationality, (...) building on Williamson’s ( 2002 ) suggestion that we should commence with successful performances as the foundation for both domains, be it action or knowledge. By highlighting the limitations of higher-order regulative approaches in epistemology, exemplified by Sosa ( 2007, 2011, 2015, 2021 ), the paper introduces a form of teleological epistemic constitutivism inspired by Velleman ( 2000, 2009 ). The proposal is that epistemic ownership is not attained in the mere pursuit of truth or knowledge, but requires furthermore a struggle to understand what we know. (shrink)

De fondo está la doble alternativa del «deontologismo» y del «teleologismo»... A partir de esos dos planteamientos generales se configuran las orientaciones en el campo de la Bioética actual. El prevalente, sobre todo en el mundo anglosajón, es el llamado «principialismo». LA BIOÉTICA (...) Y EL PRINCIPIO DE SOLIDARIDAD contribuye a consolidar la teoría de los principios bioéticos desde una óptica cristiana. A reassessment of the political and religious aspects of Philip of Spain’s reign in England and of the kingdom’s integration into the Spanish Monarchy.

The objective of this paper is to reflect on the proper way for Christians to do philosophy, in respect of which I have been inspired by a phrase attributed to Cardinal Newman: “We do not need Christian philosophy. We need Christians making good philosophy.” This sentence can appear controversial, but I believe it is not, if its content is made explicit in an appropriate way. To better develop what I understand Newman to be proposing here, I have added another category (...) to his statement, with the consequence that my own text falls into three sections: 1) on Christian philosophy; 2) on Christian philosophers; 3) on Christians who do philosophy. This is the scheme that we will use to position ourselves as regards the complex issue of the relationship between philosophy and Christianity. (shrink)

Trabajar en las aulas la memoria histórica, como temática controvertida y que suscita debate social, es un reto de la enseñanza de las ciencias sociales. A nivel global han sido innumerables las acciones desarrolladas para que se recupere la memoria de aquellas personas silenciadas durante décadas, unidas a conflictos sociales y políticos. Sin embargo, existen pocas investigaciones que analicen los recursos didácticos que ofrecen las tecnologías digitales sobre la temática. En este trabajo se identifican cinco apps que tienen como eje (...) el Holocausto y se analizan sus posibilidades educativas y su tratamiento de la memoria histórica. El resultado apunta a que estas apps no presentan una arquitectura didáctica adecuada y proponen una función principalmente informativa, aunque poseen características específicas que permiten su uso en contextos educativos si se hace un buen uso de sus funcionalidades a través de una mediación adecuada. Respecto a la memoria, aunque presentan un tratamiento basado en testimonios y recuerdos individuales, obvian la necesidad de una metodología deliberativa que permita confrontar ideas y fomentar una actitud crítica ante la historia institucionalizada. The volume gathers theoretical contributions on human rights and global justice in the context of international migration. It addresses the need to reconsider human rights and the theories of justice in connection with the transformation of the social frames of reference that international migrations foster. The main goal of this collective volume is to analyze and propose principles of justice that serve to address two main challenges connected to international migrations that are analytically differentiable although inextricably linked in normative terms: (...) to better distribute the finite resources of the planet among all its inhabitants; and to ensure the recognition of human rights in current migration policies. Major proponents of both Distributed Cognition and Predictive Processing have argued that the two theoretical frameworks are strongly compatible. An important conjecture supporting the union of the two frameworks is that cultural practices tend to reduce entropy —that is, to increase predictability— at all scales in a cultural cognitive ecosystem. This conjecture connects Distributed Cognition with Predictive Processing because it shows how cultural practices facilitate prediction. The present contribution introduces the following challenge to the union of Distributed Cognition and Predictive (...) Processing: the problem of entropic cultural practices. The problem lies in the existence of multiple cultural practices that tend to increase entropy instead of reducing it. This paper discusses these entropic cultural practices and the nature of the problem at hand. Finally, the paper advances an expanded conception of cultural practices that could unite the two frameworks and explores the difficulties of committing to such a conception. (shrink)

We argue for a new conventionalism about many kinds of evolutionary groups, including clades, cohesive units, and populations. This rejects a consensus, which says that given any one of the many legitimate grouping concepts, only objective biological facts determine whether a collection is such a group. Surprisingly, being any one kind of evolutionary group typically depends on which of many incompatible values are taken by suppressed variables. This is a novel pluralism underlying most any one group concept, rather than a (...) familiar pluralism claiming many concepts are legitimate. Consequently, we must help biological facts determine grouphood, even when given a single grouping concept. (shrink)

Trías recoge esta determinación en un concepto clave de su filosofía al denominarnos “ser del límite”. En ambos filósofos somos radicalmente pasión creadora; somos un animal límite y caótico, sufriente por queriente, y potencialmente feliz por el mismo motivo. RESUMEN Este artículo reconstruye la genealogia arendtiana de las formas extremas de la violencia, tomando como hilo conductor los procesos de desingularización con un doble propósito: por un lado, analizar las (dis)continuidades históricas de dicha genealogia que trasciende la dimensión fisico-instrumental de la violencia y entra conexión con la (des)configuración de la identidad personal; por otro lado, reivindicar la vigencia de la obra de Hannah Arendt para explorar los ecos presentes de esa violencia, sin perder de vista su especificad actual. ABSTRACT This paper reconstructs the Arendtian genealogy of the extreme forms of violence, taking desingularization processes as its guiding thread, with a twofold goal: on the one hand, to analyze the historical (dis)continuities of that genealogy, that goes beyond the physical-instrumental dimension of violence and comes into connection with the (de)configuration of personal identity; on the other hand, to claim the validity of Arendt's work to explore the echoes of that violence, without losing sight of its current specificity. Entre enero y febrero de 1970, el norteamericano Saul Kripke impartió tres importantes conferencias en la Universidad de Princeton que posteriormente se publicaron bajo el titulo de El nombrar y la necesidad. En dichas conferencias el autor, además de hacer una fuerte crítica a las teorías descripcioncitas, abordó temas de primer orden, como son el de los nombres, la referencia, la rigidez, la modalidad y la necesidad. A partir, de sus tres conferencias, y del artículo “Identidad y necesidad” publicado un (...) año después (1971), abordaremos aquí cuatro puntos, a saber: 1) La necesidad e identidad en las teorías de la referencia directa, 2) Designadores rígidos y mundos posibles, 3) Bautizo inicial, 4) el nombrar y la necesidad.
